FAQs about Care Law

What is a living will ?

A Living Will gives people a chance to state their wishes regarding medical treatment and intervention in the final stages of life.

Everyone of a legal age with mental capacity has the right to consent to or reject medical treatment.  The treatments normally covered by Living Wills are artificial feeding, mechanical ventilation, antibiotic therapy and resuscitation. Living Wills are legally enforceable under the Mental Capacity Act 2005 and must be followed by healthcare professionals. When making a Living Will, a person may want to include personal details and requests such as how he might want to spend final days, and where he wishes to die, at home or in hospital, and arrangements for the funeral.
